Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the ConjuGo iOS application (the "App") and the website at conjugo.me (together, the "Service"), operated by Alojz Kovacik, based in Switzerland ("ConjuGo", "we", "us", or "our").
By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
ConjuGo's content is suitable for all ages, consistent with its App Store age rating. Creating an account is subject to a minimum age: you must be at least 13 years old to create an account, and if you are in the European Economic Area, the United Kingdom, or Switzerland and are under 16, you may only create an account with the consent of your parent or legal guardian. We do not knowingly permit accounts for children below these ages.
If you are under the age of majority in your jurisdiction, you confirm that your parent or legal guardian has read and accepted these Terms on your behalf, and that they are responsible for your use of the Service, including any purchases made through the Apple ID family arrangements they control.
2. Your account
To use most features of the Service, you must create an account by signing in with Google or with Apple. You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.
During onboarding you choose a username. It is used only to address you inside the App and does not have to be your real name. You agree not to choose a username that is unlawful, offensive, impersonates another person, or infringes anyone's rights; we may change or reset such a username.
3. Subscriptions, billing, and cancellation
All payments for the Service are processed by Apple through the App Store. We do not collect, receive, or store your payment card or bank details. Your purchase is also subject to the Apple Media Services Terms and Conditions.
3.1 Free trial
New users may be offered a free trial period. The length of any trial is shown in the App before you start it. If you do not cancel at least 24 hours before the trial ends, your subscription begins automatically and you will be charged the applicable fee.
Free trials are an optional offer, not a feature of the Service. We may change the length of the trial, restrict who is offered one, or stop offering trials entirely, at any time and for future users; this does not affect a trial already running.
One trial per person. The free trial is limited to one per person. Deleting your account and creating a new one does not make a further trial available: we keep a pseudonymous record of the fact that a trial was used, as described in section 6.2 of our Privacy Policy. We may withdraw or refuse a trial where we reasonably believe it is being claimed repeatedly by the same person.
3.2 Auto-renewing subscriptions
ConjuGo offers auto-renewing subscriptions (monthly and yearly). By starting a subscription, you acknowledge and agree that:
- Payment is charged to your Apple ID account at confirmation of purchase.
- The subscription automatically renews at the same price and for the same period, unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel subscriptions in your Apple ID Settings → [your name] → Subscriptions.
- Any unused portion of a free trial is forfeited when you purchase a subscription, if applicable.
- Cancelling stops the next renewal. It does not end the current period: you keep paid access until the period you have already paid for expires, and no partial or pro-rata refund is given for the unused part of that period.
- Switching between plans (for example monthly to yearly), and any proration that results, is handled by Apple under its rules, not by us.
3.3 Prices, taxes, and price changes
Current prices are displayed in the App before you purchase. Prices are set per App Store storefront and may differ by country and currency; the amount shown by Apple at purchase includes any taxes Apple is required to collect.
We may change our prices at any time. A price change never applies to a period you have already paid for — it applies only to renewals after the change takes effect. Where a price increase affects an existing subscription, Apple will notify you in advance and, where its rules or your local law require it, will ask for your consent; if you do not consent, your subscription will not renew at the new price. You can always avoid a price change by cancelling before the renewal date. We may, but are not obliged to, keep existing subscribers on their previous price.
3.4 Changes to plans and to what a subscription includes
We may introduce new subscription plans, rename or restructure existing ones, change the billing periods offered, and stop offering a plan to new subscribers. We may also change which features and content are included in a given plan, and which are available free of charge, as described in section 8.
If we stop offering a plan you are on, your existing subscription continues on its current terms until the end of the period you have paid for; after that it may not be renewable, and we will tell you what alternatives are available. A subscription buys you access to the Service as it exists from time to time, not to any specific feature, verb, tense, topic, or item of content.
3.5 Failed payments and lapsed subscriptions
If a renewal payment fails, Apple may retry it under its own billing-retry rules. If payment is not completed, your subscription lapses and paid features stop being available until a valid subscription is in place again. Your learning history is not deleted when a subscription lapses, and it becomes available again if you resubscribe, subject to section 6.2 of our Privacy Policy and to your account not having been deleted in the meantime.
3.6 Your subscription and your ConjuGo account
A subscription is tied to the Apple ID that bought it, not to your ConjuGo account. If you sign in on another device with the same Apple ID, use Settings → Restore Purchases in the App to restore access.
Deleting your ConjuGo account does not cancel your subscription, and neither does deleting the App. Only Apple can cancel it, in your Apple ID subscription settings. If you do not cancel there, billing continues even though you no longer have an account.
3.7 Refunds
All purchases are processed by Apple. Refund requests must be submitted to Apple through reportaproblem.apple.com. We cannot issue, approve, or refuse refunds directly, and any refund decision is Apple's. This does not affect any statutory right of withdrawal or refund you may have under the consumer law of your country of residence.
3.8 Promo codes
Promo codes, if applicable, are subject to their own terms. They have no cash value, cannot be combined unless explicitly stated, and may be revoked if used fraudulently.
4. License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on any Apple-branded device that you own or control, for your personal, non-commercial use, as permitted by the Apple Media Services Terms and Conditions.
5. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or disassemble the App, except where permitted by applicable law.
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Attempt to gain unauthorized access to our systems, other users' accounts, or any non-public areas of the Service.
- Interfere with, disrupt, or overload the Service.
- Resell, sublicense, rent, or otherwise commercially exploit the Service.
- Use automated scripts, bots, or scrapers without our prior written consent.
6. Intellectual property
The Service, including all content, software, and trademarks (but excluding user-generated content), is owned by ConjuGo and its licensors, and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership to you.
7. Learning content: accuracy, errors, and limitations
ConjuGo is a self-study practice aid. It is not a certified language course, a translation service, a guarantee of examination success, or a substitute for a qualified teacher.
The learning content — exercises, fill-in sentences, example sentences, conjugation tables, translations, hints, explanations, and topic material — is produced using a combination of automated generation (including AI-assisted generation), linguistic data sources, and human review. As a result, and despite our efforts to correct it, the content may contain mistakes. These may include, without limitation: incorrect, incomplete, or non-standard conjugations; wrong or awkward translations; grammatical, spelling, accent, or punctuation errors; regional, dated, or informal usage presented without that label; sentences that read oddly or ambiguously out of context; mislabeled tenses, moods, or difficulty levels; and occasional wording that you may find clumsy, insensitive, or otherwise inappropriate.
French usage also varies legitimately by region, register, and period, and reputable sources disagree with each other. A difference between ConjuGo and another source is therefore not necessarily an error in either.
Accordingly, and to the fullest extent permitted by law, we make no representation or warranty that any item of learning content is accurate, complete, current, idiomatic, appropriate, or fit for any particular purpose. You should not rely on ConjuGo as your only source where accuracy matters — including examinations, academic work, professional, official, or legal translation, employment or immigration paperwork, and medical or safety-critical communication. Verify such material with a qualified teacher, an authoritative reference work, or a professional translator.
Example and practice sentences are illustrative language material only. They are not statements of fact, advice, or opinion of ours about any person, group, organization, or subject, and any resemblance to a real person or event is unintended.
If you find an error, or content you consider inappropriate, please tell us at support@conjugo.me and we will review it and, where we agree, correct it. Reporting an error is the quickest way to have it fixed; our liability in respect of the learning content is otherwise limited as set out in sections 9 and 10.
8. Changes to the Service
ConjuGo is under continuous development. We may, at any time and without prior notice, and at our discretion:
- add, change, replace, correct, or remove features, exercises, verbs, tenses, topics, and any other content;
- change how existing features behave, look, or are organized;
- change the composition of subscription tiers, including which features and content are available free of charge and which require a paid subscription (subject to section 3.3 on prices); and
- impose reasonable limits on use, or suspend, restrict, or discontinue the Service or any part of it.
We may do this to improve or fix the Service, or for technical, editorial, legal, security, or commercial reasons. No individual feature, verb, tense, topic, or item of content is guaranteed to remain available, and none of them forms a separately purchased part of a subscription. Continued use of the Service after a change constitutes acceptance of it.
If we permanently discontinue a paid feature that formed a significant part of a subscription you have already paid for, or discontinue the Service altogether during a period you have paid for, you may cancel your subscription so that it does not renew and, where you believe a refund is due, request one from Apple at reportaproblem.apple.com — all purchases are processed by Apple, and only Apple can issue refunds. Nothing in this section affects any mandatory rights you have under the consumer-protection law of your country of residence.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any information it provides — including the learning content described in section 7 — is accurate, complete, or up to date. We do not guarantee any particular learning outcome, level of proficiency, or examination result. You use the Service at your own risk.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, ConjuGo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim, or CHF 100, whichever is greater.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (including liability for gross negligence, willful misconduct, or death or personal injury caused by negligence).
11. Indemnification
You agree to indemnify and hold ConjuGo harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
12. Termination
You may stop using the Service at any time and delete your account from the App's Settings. We may suspend or terminate your access immediately and without notice if you breach these Terms, if we reasonably suspect fraud or abuse, or if required by law. We may also terminate or discontinue the Service, or any part of it, for any reason on reasonable notice; if we do, section 8 governs what happens to any subscription period you have already paid for. Provisions that by their nature should survive termination (including IP ownership, disclaimers, limitations of liability, indemnification, and governing law) will survive.
13. Apple-specific terms
The following applies to your use of the App on an Apple device:
- These Terms are between you and ConjuGo only, not with Apple. Apple is not responsible for the App or its content.
- Your license to use the App is limited to use on an Apple-branded device you own or control, in accordance with the Apple Media Services Terms.
- ConjuGo, not Apple, is solely responsible for providing maintenance and support, and for any product claims, warranties, or liabilities relating to the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation with respect to the App.
- ConjuGo, not Apple, is responsible for addressing any claims by you or a third party relating to the App (including product liability, consumer protection, and intellectual property infringement claims).
- You represent that you are not located in a country subject to a U.S. government embargo, and that you are not listed on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.
14. Governing law and disputes
These Terms are governed by the laws of Switzerland, without regard to its conflict-of-laws rules. Exclusive jurisdiction for any dispute lies with the competent courts of Switzerland, subject to any mandatory consumer-protection rights you may have under the laws of your country of residence.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you in the App or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. General
- Feedback. If you send us suggestions, bug reports, or corrections to the learning content, you grant us a perpetual, worldwide, royalty-free license to use them to improve the Service, without obligation or compensation to you.
- Third-party services. The Service relies on services provided by Apple and Google (including Firebase). Their own terms apply to your use of those services, and we are not responsible for them.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be replaced by an enforceable one that most closely reflects its intent.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign or transfer these Terms. We may assign or transfer these Terms, and our rights and obligations under them, without your consent, to a successor or affiliated entity — including in connection with a merger, acquisition, financing, reorganization, sale of assets, or the incorporation of the business currently operated by Alojz Kovacik into a company — provided the successor assumes our obligations under these Terms. We will notify you of any such transfer.
- Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including outages of Apple or Google services, natural disasters, war, governmental action, or failures of the internet.
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ConjuGo regarding the Service and supersede any prior understanding.
